Private companies in Kuwait now required to switch to digital scheduling for their work hours
Sheikh Fahad Al-Yousef, the First Deputy Prime Minister and Minister of Interior, has issued a resolution regarding work schedules in the private sector. The resolution, published by the official government gazette, will come into force on November 1 this year.
The resolution requires private-sector employers to enter daily working hours, rest periods, weekly rest, and official holidays into the Public Authority for Manpower's electronic system. Once the data is approved by the authority, the work schedule will be considered official. Employers are obliged to print and display the official work schedule visibly at their workplace.
Employers are also required to update the aforementioned information immediately whenever changes occur. The authority's approval of the data constitutes official validation of the work schedule. The Public Authority for Manpower's electronic system will serve as the official reference for inspectors during inspections and follow-ups.
Article 2 of the resolution specifies that the data entered into the authority's electronic system will be the official reference for inspectors. Article 4 states that the resolution will be published in the Official Gazette and take effect on November 1 this year.
The resolution's implementation is the responsibility of the competent authorities, as stated in Article 4. The resolution's effects are not limited to partial suspension but may also include full suspension of an employer's file. Article 3 of the resolution allows the Public Authority for Manpower to take legal action against employers violating the resolution, including partial or full suspension of the employer's file.
The resolution does not alter Article 141 of Law No. 6 of 2010. As reported by Al Anba newspaper, the resolution applies to private-sector employers. The resolution mandates compliance by the specified date of November 1 this year.
Employers are encouraged to familiarise themselves with the resolution and ensure compliance to avoid any potential legal action. The resolution aims to ensure fair and regulated working hours in the private sector, providing a better work-life balance for employees.
