Microsoft had recently found itself in a firestorm, following the blockage of Karim Khan's email account, a move that was a fallout of U.S. President Donald Trump's sanctions against the International Criminal Court (ICC) in February. The Hague-based court had issued arrest warrants against Israeli Prime Minister Benjamin Netanjahu and his former defense minister Yoav Gallant for alleged war crimes in the Gaza Strip in November. The sanctions threaten the court's functioning. Both the U.S. and Israel refuse to recognize the court. Khan temporarily stepped down from his post amidst an investigation into allegations of sexual misconduct.

Microsoft's new strategy is reportedly the outcome of a thorough legal reassessment regarding handling shutdown orders issued by the U.S. President, according to the report by Wirtschaftswoche. The company claims to have developed a legal framework to comply with such orders in the future without having to shut down customer accounts. Microsoft refrains from disclosing the specifics, but a company spokesperson confirmed the new legal standpoint to Wirtschaftswoche. The spokesperson stated, "We will continue to work hand in hand with the ICC."

The company appears to rely on the fact that it offers a technical platform for customers to provide digital services to their employees or third parties, but does not directly provide services to individuals. In future cases, Microsoft plans to avoid taking direct action, as seen with the ICC incident, with the decision on deactivating user accounts being left to the customers.
